To use our service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials

• Use only your own photos or photos you have permission to use

You are responsible for all activities that occur under your account.

4.1 Credit System

• Each headshot generation consumes one credit
• Credits can be purchased as one-time packs or monthly subscriptions
• Subscription credits roll over for up to 3 months, capped at 2× your monthly plan
• One-time credit packs expire 90 days after purchase
• Credits are consumed using First Expiring, First Out (FEFO) logic

4.2 Billing and Payments

• All payments are processed securely through Stripe
• Subscription fees are billed monthly in advance
• One-time purchases are charged immediately
• All sales are final - no refunds for used credits
• Prices are subject to change with 30 days notice

4.3 Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• Unused subscription credits remain valid until consumed or expired
• No refunds for partial months or unused credits

5.1 Your Content

• You retain ownership of photos you upload
• You grant us a limited license to process your photos for service delivery
• You represent that you have the right to use any photos you upload
• We do not claim ownership of your original photos
• Your photos are processed in memory and are not stored on our servers

5.2 Generated Content

• You own the rights to headshots generated from your photos
• Generated headshots are for your personal and professional use
• You may use generated headshots for business purposes, social media, and professional profiles
• You may not resell or redistribute generated headshots to third parties
• Generated headshots are provided immediately and are not stored on our servers

5.3 Our Intellectual Property

• Our AI technology, algorithms, and service platform remain our property
• You may not reverse engineer or attempt to extract our AI models
• Our trademarks, logos, and branding are protected intellectual property

You agree not to use our service to:

• Upload photos of people without their consent
• Generate inappropriate, offensive, or illegal content
• Attempt to circumvent our credit system or security measures
• Use automated tools to access our service
• Upload copyrighted material without permission
• Create deepfakes or misleading content
• Violate any applicable laws or regulations

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our service, you agree to the collection and use of information in accordance with our Privacy Policy.

• We process your photos only to generate headshots
• We do not store your photos longer than necessary
• We use industry-standard security measures to protect your data
• We do not share your personal information with third parties without consent

• We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service
• We may temporarily suspend service for maintenance or updates
• AI-generated results may vary and are not guaranteed to meet specific expectations
• We reserve the right to limit usage to prevent abuse
• Service may be unavailable due to factors beyond our control

9.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIGHTFACE.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

9.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

• You may terminate your account at any time
• We may suspend or terminate your account for violation of these terms
• Upon termination, your right to use the service ceases immediately
• We may delete your account data after a reasonable period
